Just In: New Montana Legislation Defines The Genders Male And Female According To Biology And Chromosomes, Instead Of An Individual’s Personal Experience

A Montana legislation aims to clarify “gender” in compliance with the law as a male or a female, according to the “biological sex” at the time of birth, and overlooking a person’s preferred gender identity or personal experiences. 

As per NBC Montana, Senate Legislation 458 will be clarifying sex on the basis of the functionality of an individual’s reproductive system, hence, this legislation is being opposed by the transgender community and the Democrats.

The legislation stated that: 

“Sex is determined by the biological indication of male or female, including sex chromosomes, gonads, and nonambiguous internal and external genitalia present at birth, without regard to an individual’s psychological, chosen, or subjective experience of gender.”

The Bill, introduced by GOP State Senator Carl Glimm, also elaborates on both genders, male and female. 

The legislation defines males as: 

“A member of the human species that, under normal development, produces small, mobile gametes, or sperm, during his life cycle and has a reproductive and endocrine system oriented around the production of that gamete. An individual who cannot produce sperm due to a condition at birth, but who has female sex chromosomes and nonambiguous external genitalia is a male member of the human species.”

The legislation defines females as:

A member of the human species that, under normal development, produces a … relatively large, relatively immobile gamete, or egg, during her life cycle and has a reproductive and endocrine … system oriented around the production of that gamete. An individual who cannot produce an egg due to a condition at birth, but who has male sex chromosomes and nonambiguous internal genitalia is a female member of the human species.”

Sen. Glimm also issued a statement in which he argued that sex, gender, and biological sex are separate. 

He stated:

“We’ve heard bills this session about the existence of multiple genders, gender fluidity, gender transition, gender expression, transgenderism. But that’s not what this bill is about. Gender obviously means something different than biological sex. Biological sex is immutable. You can’t change it.”
